Delhi HC Orders Removal of Defamatory Post Targeting BJP Leader Gaurav Bhatia

The Delhi High Court has taken a significant step in safeguarding the reputation of Bharatiya Janata Party (BJP) leader and advocate Gaurav Bhatia by directing a social media account named ‘Ranting Gola’ to delete a contentious post concerning his recent television appearance. This move comes in response to a defamation lawsuit filed by Bhatia against the account, which had been actively circulating the post on various platforms.

The controversy erupted following Bhatia’s appearance on a News18 show hosted by journalist Amish Devgan in September. During the broadcast, a camera angle captured Bhatia dressed in a kurta, leading to widespread speculation about his attire, as he appeared to be without traditional pyjamas or pants. Social media users quickly seized the moment, sharing the clip extensively across platforms, which ultimately prompted Bhatia to clarify that he had been wearing shorts at the time.

On Friday, the High Court’s bench instructed Shamita Yadav, the individual behind the Ranting Gola account, to remove the post at once, emphasizing that its continued presence could cause harm to Bhatia’s reputation. Bhatia’s legal team argued that the post was not only misleading but also constituted a breach of an interim order issued in his favor in September.

In her defense, Yadav’s counsel asserted that her client is a content creator who does not align with any political party, claiming that the post was intended as a piece of satire rather than a malicious attack. The lawyer highlighted that Yadav’s social media presence is labeled as comedic, attempting to frame the incident within the realm of humor rather than defamation.

This case underscores the growing tensions between public figures and social media content creators in India, where the lines between satire, opinion, and defamation are often blurred. As digital platforms continue to expand, the regulation of content and the protection of individuals’ reputations remain crucial topics within Indian jurisprudence.
