In a significant ruling, the Delhi High Court has granted interim bail to Abdul Rashid Sheikh, better known as Engineer Rashid, allowing him to participate in the 40th-day rites for his late father in Jammu and Kashmir. The decision, made on Tuesday, comes amidst Sheikh’s ongoing legal troubles stemming from a terror-funding case that has seen him incarcerated since August 2019 under the Unlawful Activities Prevention Act (UAPA).

The bench, comprising Justices Prathiba M Singh and Madhu Jain, recognized the emotional and cultural significance of the rituals that follow the death of a loved one in Indian society, particularly the 40th-day ceremony, which is an important observance in many communities across the country. The court has permitted Sheikh to attend these rites while highlighting that he must surrender again once the interim bail period expires on June 3.

His arrest in 2019 was part of a larger crackdown on alleged terror financing, leading to widespread debates about civil liberties and the application of the UAPA.
