Supreme Court Backs Electoral Roll Revision; Assam Advances Uniform Civil Code Bill

The Supreme Court of India has affirmed the legality of the Election Commission’s special intensive revision of electoral rolls, emphasizing that this initiative is integral to ensuring free and fair elections. The apex court clarified that while the Election Commission possesses the constitutional authority to execute such exercises, it cannot determine an individual’s citizenship status during the process of updating the voter list.

The court’s ruling comes in the wake of concerns regarding certain individuals in Bihar whose names were removed from the electoral rolls due to questions surrounding their citizenship. In a significant directive, the Supreme Court instructed the Election Commission to submit the names of these individuals to the Union government within one week, enabling a review of their citizenship claims. This move aims to enhance the integrity of the electoral process while respecting the constitutional rights of all citizens.

Meanwhile, the Assam Assembly has made a notable stride toward legal reform by passing the Uniform Civil Code (UCC) bill, which seeks to prohibit polygamy and mandate the registration of live-in relationships. This legislative action positions Assam as the third Indian state to adopt such a code since independence, following Uttarakhand and Gujarat.

Chief Minister Himanta Sarma voiced strong support for the bill, asserting that it reflects the progressive values of the state. However, he also confirmed that the UCC would not apply to Assam’s tribal communities, acknowledging the unique cultural practices of these groups. The decision to pass the bill came despite opposition calls for further examination by a select committee, highlighting the contentious nature of the legislation.

The introduction of the UCC in Assam could potentially transform the legal landscape surrounding marriage and personal relationships in the state, aiming for greater equality and transparency. As the debate surrounding personal laws continues, the impact of this legislative change will be closely monitored both within and outside Assam.
