Adani Group Fights Back: Seeks Dismissal of US Fraud Case Over Jurisdiction Issues

In a significant legal maneuver, Gautam Adani, the chairman of the Adani Group, has taken steps to dismiss a fraud case brought against him and his nephew, Sagar Adani, by the U.S. Securities and Exchange Commission (SEC). The case, which alleges that they engaged in bribery related to solar energy contracts in India, has been challenged on the grounds of extraterritorial overreach of U.S. law.

The allegations trace back to November 2024, when the SEC indicted both Adani family members for purportedly orchestrating a scheme to bribe Indian officials to secure favorable contracts for solar energy projects. The commission claims that the Adani Group misrepresented its anti-bribery measures to U.S. investors, particularly in connection with a $750 million bond offering that took place in 2021.

In their legal petition, which has been filed in the Eastern District Court of New York, the Adanis argue that the SEC’s claims lack a solid legal foundation. They maintain that the court does not possess personal jurisdiction over them, as neither individual has substantial connections to the United States. The petition emphasizes that the bond offering was executed outside of the U.S., and the securities were sold to underwriters that were also based internationally, distancing them from any direct engagement with U.S. markets.

The controversy surrounding the Adani Group has not only attracted the attention of regulatory bodies but has also sparked widespread discussions about corporate governance and accountability in India. The allegations of fraud and bribery have raised questions about the ethical practices within one of India’s largest conglomerates, known for its extensive investments across various sectors including energy, logistics, and infrastructure.

This case highlights the complexities of international law and the challenges companies face when operating across borders, particularly in an era where regulatory scrutiny is intensifying globally.
