Adivasi Struggles with Forest Rights Act Highlight Implementation Flaws

Kamal Pardhi, an Adivasi woman from Shahpur in Maharashtra’s Thane district, shared her bittersweet experience with the Forest Rights Act. After navigating a maze of applications, her husband, Vithal, finally secured a land title for the 20 ghuntas (approximately half an acre) they had been farming. However, their joy was short-lived when they discovered that the title was issued in someone else’s name.

Despite numerous attempts to rectify this mistake, authorities have yet to address the issue, leaving Pardhi frustrated and unsure of her next steps. “What am I supposed to do now?” she lamented, highlighting the ongoing struggles faced by many in her community.

Pardhi’s case was one of forty presented at a Jan Sunwai, or public hearing, concerning the Forest Rights Act held at the YB Chavan Centre in South Mumbai on February 24. This event was organized by the Yashwantrao Chavan Centre, Shoshit Jan Andolan, and the Peoples’ Union for Civil Liberties in Maharashtra, aiming to expose the numerous challenges surrounding the implementation of a law designed to address historical injustices faced by Adivasis and traditional forest dwellers.

Enacted in 2006, the Forest Rights Act seeks to acknowledge the rights of Adivasis and other forest communities to land, resources, and self-governance. It’s a commendable effort, but many, like Pardhi, find themselves entangled in bureaucratic loopholes that hinder their rightful ownership and security.

As the hearing unfolded, it became clear that many similar stories of distress were being drowned out by the system meant to support them. The issues surrounding misallocated documents and misplaced applications serve as a stark reminder that while the law was designed to empower, its implementation leaves much to be desired. The Adivasi community is left questioning not just their rights, but the very system that is supposed to protect those rights.
