Allahabad HC Grants Security to Muslim Man After Alleged Interference in Namaz on His Land

In a significant ruling, the Allahabad High Court has ordered the deployment of two security guards to protect a Muslim man, Haseen Khan, who claimed he was prevented from performing namaz on his own property in Bareilly district, Uttar Pradesh. The incident has raised concerns over religious freedom and property rights in the region.

Khan reported that he and others were threatened by certain individuals who warned that his property in the Mohammad Ganj village would face demolition unless he complied with their demands regarding a statement in court. This intimidation led him to seek legal intervention, underscoring the precarious situation faced by minorities in certain areas.

During the proceedings, Khan alleged that police officials coerced him into giving his thumb impression on a document without clarifying its contents. In light of these serious allegations, he asked the court for protection for himself and his family. The judges, Justices Atul Sreedharan and Siddharth Nandan, responded promptly, ensuring that armed guards would be assigned to safeguard Khan until further notice.

The court also noted that any acts of violence against Khan or his property would, prima facie, be deemed as having occurred “at the instance of the state.” This declaration is significant as it holds authorities accountable for the safety of citizens, particularly in cases that may involve religious discrimination.

Interestingly, this ruling comes on the heels of an earlier decision by the Allahabad High Court, which stated that no permission is needed for religious gatherings on private property, as long as they are contained within the premises. Such rulings reflect an ongoing dialogue about religious rights and civil liberties in India.
