In a significant development in the ongoing liquor policy case, the Delhi High Court issued a notice to the Central Bureau of Investigation (CBI) on October 16, 2023, concerning a plea filed by Arvind Kejriwal, the Chief Minister of Delhi and leader of the Aam Aadmi Party (AAP). Kejriwal is requesting the recusal of Justice Swarana Kanta Sharma from presiding over the CBI’s appeal against his discharge from the case.

The case revolves around a trial court decision made on February 27, which dismissed charges against Kejriwal, former Deputy Chief Minister Manish Sisodia, and 21 other co-accused individuals. The CBI has challenged this ruling, seeking to reinstate the charges based on allegations of corruption linked to the liquor policy implemented during Kejriwal’s administration.

During the hearing, Kejriwal, who attended the court alongside his wife, expressed his intention to personally present his arguments for the recusal application. However, Justice Sharma clarified that such a move would require Kejriwal to withdraw his legal representation. Solicitor General Tushar Mehta, representing the CBI, pointed out that there had been seven requests for the judge’s recusal, underscoring the serious nature of the allegations being made.

Mehta remarked, “Some individuals in this country have made careers out of leveling serious allegations,” emphasizing the potential harm such claims could inflict on judicial integrity. He expressed the CBI’s intent to defend the institution of the judiciary, highlighting the importance of public trust in the legal system. Furthermore, he mentioned that while there were no objections to Kejriwal appearing in person, his counsel would no longer be able to represent him if he pursued that route.

The implications of this case are far-reaching, as it not only impacts the political landscape in Delhi but also raises questions regarding the accountability of public officials. Kejriwal’s government has faced scrutiny over its liquor policy, which has been alleged to have favored certain businesses and led to substantial financial losses for the state.
