Election Commission Faces Backlash Over Takedown Notices Amid Controversial Guidelines

This week, the Election Commission of India found itself embroiled in a fresh controversy when a document from 2019 resurfaced, stirring heated debates and widespread criticism. The document, which contained guidelines for electoral candidates, became a focal point of contention due to its association with the ruling Bharatiya Janata Party (BJP). While the guidelines themselves were innocuous, their connection to the BJP raised eyebrows among opposition leaders, who swiftly seized the opportunity to criticize the Election Commission.

The Election Commission scrambled to manage the fallout, attributing the mishap to a “clerical error”. They explained that a request for clarification from the BJP led to an official inadvertently sharing the guidelines with other political parties. However, the damage was done; as the document circulated on social media, it caught the attention of journalists who reported on the situation. Many of these journalists began receiving notices from the Kerala Police, alleging that their posts had “insulted” the Election Commission and threatened communal harmony.

Adding to the controversy, social media platforms Instagram and Facebook took action by blocking posts that covered the issue, citing a “legal request” from authorities. This incident has raised concerns about press freedom in India, especially as the nation approaches crucial state elections. The Election Commission’s recent approach to the media has polarized opinions, with many arguing that its actions signify a growing tension between the electoral body and the press.

Since the appointment of Gyanesh Kumar and Sukhbir Singh Sandhu to the Election Commission in March 2024, there has been a noticeable shift in the relationship between the Commission and journalists. Rather than engaging openly, the Commission’s strategy appears to rely on silence, which only adds fuel to the fire of speculation and discontent among media circles.

As the political landscape heats up with state polls on the horizon, this incident underscores a critical need for clarity and transparency from the Election Commission. The ongoing tensions between political entities and the media could have significant implications for the integrity of the electoral process. Journalists and news organizations must navigate these challenges while continuing to uphold their role as watchdogs in a democratic society.
