Kolkata Tribunal Restores Congress Candidate’s Voter Status Ahead of West Bengal Elections
In a significant development ahead of the approaching Assembly elections in West Bengal, the Appellate Tribunal in Kolkata has reinstated the voter status of Motab Shaikh, who is the Congress candidate contesting from Farakka. This decision marks a pivotal moment, as it is the first case adjudicated by the tribunal, highlighting ongoing concerns regarding the electoral roll revisions in the state.
Judge TS Sivagnanam, a retired chief justice of the Calcutta High Court, presided over the case and expressed concerns over the Election Commission’s lack of transparency. The commission cited “technical reasons” for the omission of Shaikh’s name from the voter list, but failed to provide specific details regarding the circumstances that led to this decision. This lack of clarity has raised eyebrows, especially with the elections just around the corner, set for April 23 and 29, with results to be declared on May 4.
The backdrop to this situation is the ongoing intensive electoral roll revision process in West Bengal, where over 61 lakh voters have reportedly been excluded from the final electoral roll published by the Election Commission on February 28. This figure is alarming, given that it represents a significant portion of the electorate. Additionally, the commission has been grappling with around 60 lakh cases classified as “doubtful and pending,” many of which are still under consideration due to objections regarding their removal from the draft rolls that were released in December last year.
The Supreme Court intervened on February 20, mandating that judicial officers of district judge rank or higher oversee the resolution of these cases, emphasizing the importance of fairness and transparency in the electoral process. The tribunal’s ruling in favor of Shaikh may set a precedent for others who find themselves in similar situations, raising hopes for those who have faced unjust exclusion.
This incident not only underscores the complexities and challenges surrounding the electoral process in West Bengal but also highlights the broader implications for democracy in India, where the right to vote is fundamental. As political parties gear up for the elections, ensuring every eligible voter’s participation is paramount for a fair representation of the people’s will.
