Lok Sabha Approves Controversial Trans Rights Bill Amid Opposition Outcry

In a significant move on Tuesday, the Lok Sabha passed the 2026 Transgender Persons Protection of Rights Amendment Bill through a voice vote, paving the way for its consideration in the Rajya Sabha. If the Upper House approves the bill, it will subsequently be forwarded to the President for final assent. The bill aims to amend the 2019 Transgender Persons Protection of Rights Act, most notably by revising the definition of who qualifies as a transgender individual.

The proposed amendments have stirred controversy, as they effectively strip transgender persons of their right to self-identify their gender. Instead, eligibility will now be contingent upon specific biological or physiological traits, intersex variations, or adherence to particular socio-cultural identities, such as kinner, hijra, aravani, and jogta. This shift in legal language has drawn sharp criticism from various opposition parties, who label the bill as ‘draconian’ and indicative of the ruling Bharatiya Janata Party’s (BJP) insensitivity towards the transgender community.

The dissenting voices in Parliament have raised concerns that the amendments undermine the landmark 2014 Supreme Court judgement in the National Legal Services Authority v. Union of India case, commonly referred to as the NALSA case. This ruling recognized transgender individuals as a third gender and mandated the government to ensure their access to affirmative action, such as job reservations and educational opportunities. Critics assert that the current bill contradicts the spirit of this judicial verdict, potentially rolling back hard-won rights for the transgender population.

As the bill makes its way to the Rajya Sabha, the debate surrounding it has intensified. Opposition leaders express that the amendments are not only discriminatory but also reflect a broader neglect of social justice issues by the current government. They argue that any legal framework governing the rights of transgender persons should prioritize self-identification and respect the community’s autonomy.

The ongoing discussions in Parliament highlight a crucial intersection of rights, identity, and legal recognition in India. Advocates for transgender rights are urging for a more inclusive approach, one that resonates with the spirit of the NALSA judgement and embraces the diverse identities within the transgender community.
