Madras High Court Temporarily Halts Proceedings Against Ex-Minister K Ponmudy Over Controversial Remarks
The Madras High Court has issued a temporary stay on the legal proceedings against former Tamil Nadu Minister K Ponmudy, who has been embroiled in controversy over comments deemed offensive to certain Hindu sects. This decision was made on Thursday as Justice A.D. Jagadish Chandira responded to Ponmudy’s petition requesting a suspension of the ongoing trial until his prior plea to quash the magistrate court’s recognition of the complaint is resolved.
Ponmudy’s remarks, made during a public event in Chennai on April 6, have sparked outrage across various communities. In a widely circulated video from the event, he appears to make a connection between sexual positions and the two major Hindu sects of Shaivism and Vaishnavism while making a joke involving a sex worker. These statements have led to accusations of hate speech, prompting legal action against him.
On April 17, 2025, the Madras High Court took note of the situation and directed the Tamil Nadu police to file a First Information Report (FIR) against Ponmudy. However, when the police did not follow through with the registration of a case, the court initiated suo motu proceedings, asserting that the former minister’s comments constituted hate speech. In a twist, on September 16, the court closed the proceedings after the Tamil Nadu government informed that the complaints against Ponmudy had been thoroughly investigated and found to lack incriminating evidence.
Despite the closure of the case, the court has permitted the complainants to continue their pursuit of justice. The situation reflects the delicate balance of political discourse and communal harmony in Tamil Nadu, a state known for its diverse cultural and religious landscape. The implications of Ponmudy’s statements and the subsequent legal actions raise important questions about freedom of speech, accountability, and the sensitive nature of religious discourse in India.
This case has become a focal point for discussions around hate speech and the responsibilities of public figures in their statements. As the legal proceedings unfold, it remains to be seen how they will further shape the political landscape and societal attitudes in Tamil Nadu.
