Rajasthan High Court Retracts Critical Comments on Transgender Rights Amendment Bill

The Rajasthan High Court has recently retracted portions of its remarks concerning the 2026 Transgender Persons Protection of Rights Amendment Bill, which have sparked considerable debate across the nation. Initially, in a judgement epilogue released earlier this week, Justice Arun Monga expressed concern that the newly amended bill, which received presidential assent concurrently, undermines the right to self-perceived gender identity established by the original 2019 Transgender Persons Protection of Rights Act.

Justice Monga articulated that the amendment represents a significant deviation from the constitutional framework that guaranteed individuals the autonomy to identify their gender. According to him, the latest version of the legislation stipulates that legal acknowledgment of gender identity would now hinge upon certification and administrative approval, rather than being solely determined by individual self-identification. This shift has raised alarms among advocates for transgender rights, who argue that it constitutes a setback for the community.

However, in a subsequent ruling issued on Thursday, the Rajasthan High Court clarified that these critical remarks were unintended and had been included “by mistake.” This retraction came as a surprise to many, especially in light of the growing scrutiny surrounding the amendment bill, which had been passed by Parliament on March 25 after a motion to refer it to a select committee was voted down. The bill had been introduced in the Lok Sabha just days earlier, on March 13.

The 2026 amendment has drawn significant criticism from various corners, particularly due to its redefinition of who qualifies as a transgender person. By limiting the law’s applicability to those with specific biological or physiological traits, intersex variations, or particular socio-cultural identities, many advocates fear that it disregards the broad spectrum of gender identities that exist. The concern is that the legislation might not only marginalize a substantial segment of the transgender community but also create further barriers to accessing their rights.

As the debate around this amendment intensifies, it is essential for lawmakers and society at large to engage in constructive dialogue that prioritizes the dignity and rights of all individuals, irrespective of their gender identity. The implications of such legislation are profound, affecting not only the transgender community but also the core principles of equality and justice enshrined in the Indian Constitution.
