US Report Highlights Politically Charged Takedown Requests in India’s Digital Space

The latest report from the United States government has brought to light concerns regarding India’s approach to online content regulation. According to the 2026 National Trade Estimate Report on Foreign Trade Barriers, American companies have increasingly been faced with takedown requests from the Indian government since 2021, underscoring a pattern that appears politically motivated.

This comprehensive report, released by the Office of the United States Trade Representative, outlines various barriers that US businesses encounter while operating in diverse markets, including India. Among the notable challenges are tariffs, quality control mandates, and government subsidies that complicate trade relationships.

Focusing specifically on India’s digital landscape, the report pointedly critiques the Information Technology Intermediary Guidelines and Digital Media Ethics Code Rules, introduced by the Indian government in February 2021. These regulations govern social media platforms, streaming services, and online news outlets, establishing a framework that many US stakeholders have deemed overly stringent and potentially threatening to free expression.

One of the most alarming aspects highlighted in the report is the imposition of personal criminal liability on employees of companies that fail to comply with the IT rules. This provision raises significant concerns about the pressure it places on individuals, particularly in a fast-evolving digital environment where compliance can be subjective and ambiguous. Furthermore, the report points out that the compliance deadlines set by these regulations are often impractical, adding to the challenges faced by foreign businesses in adhering to local laws.

The Indian government further amended the IT rules in October 2025, defining more explicitly the authorities permitted to request the removal of online content. Such adjustments have not quelled concerns from American companies about the potential misuse of these regulations for political ends. Critics argue that these measures could stifle dissent and limit the freedom of expression in India, which is increasingly seen as a vital democratic value.

In an interconnected world where digital content transcends borders, regulations that are perceived as politically motivated can impact not only trade but also the very fabric of democratic society. The US report serves as a reminder of the need for balanced policies that protect both national security and freedom of expression, ensuring that the digital realm is a space for open dialogue rather than suppression.
