Bhojpuri singer and satirist Neha Singh Rathore has been granted anticipatory bail by the Supreme Court of India in connection with legal issues stemming from her social media commentary on the Pahalgam terrorist attack in Jammu and Kashmir. This decision, made on Tuesday, follows the court’s earlier provision of interim protection from arrest on January 7, 2023.
The Supreme Court bench, consisting of Justices J.K. Maheshwari and A.S. Chandurkar, confirmed the interim relief as permanent, which has eased Rathore’s legal troubles for the time being. The case against her originated from a complaint filed in Lucknow, alleging violations of several sections under the Bharatiya Nyaya Sanhita that deal with national unity, sovereignty, and the promotion of disharmony among communities, alongside charges under the Information Technology Act.
In her controversial social media post, Rathore suggested that the Pahalgam attack on April 22 was indicative of a failure in intelligence and security by the ruling Bharatiya Janata Party (BJP). She also made pointed remarks about Prime Minister Narendra Modi, suggesting he might exploit such tragic events for political gain, similar to claims made after the 2019 Pulwama attack.
Initially, Rathore sought to have the first information report (FIR) against her dismissed by the Allahabad High Court; however, the court rejected her plea. Following that setback, she escalated the matter to the Supreme Court, where she faced further challenges in quashing the FIR.
This case highlights the ongoing tension between freedom of expression and national security in India, particularly among artists who often tread the fine line of political commentary. Rathore’s plight has resonated with many who believe that artistic expression should not be stifled by legal repercussions.
