A petition has been filed in the Supreme Court seeking a Special Investigation Team (SIT) probe against Chief Election Commissioner (CEC) Gyanesh Kumar and an audit of the Election Commission's databases. The plea, filed by advocate Shailendra Mani Tripathi, argues that Mr. Kumar is not immune from investigation or prosecution in connection with alleged "unilateral, unauthorised, and illegal decisions" and alleged manipulation of electoral rolls.

The petition alleges that "intentionally manipulating records, committing forgery, or subverting the constitutional electoral process in the course of discharging official duties" cannot be treated as an integral part of official duties. It also refers to reports that two other Election Commissioners, Sukhbir Singh Sandhu and Vivek Joshi, recorded written dissents and objections against decisions concerning the electoral roll revision exercise.

The plea further alleges irregularities including the unilateral alteration of the statutory Form 6 for first-time young voters, disenfranchisement allegedly linked to software-related issues, and alleged action in West Bengal through appeals challenging the restoration of voters by judicial officers.

The petition argues that the CEC does not enjoy personal immunity from criminal prosecution and seeks to hold him accountable under applicable law. It cites Section 32 of the Representation of the People Act, 1950, and provisions of the Bharatiya Nyaya Sanhita (BNS).

The Supreme Court has been requested to constitute an independent, high-powered Judicial Inquiry Commission or SIT headed by a retired judge to investigate the allegations, including an end-to-end audit of Election Commission databases and an inquiry into the alleged deletion of around 13 crore names during the Special Intensive Revision (SIR) exercise. The petition also seeks investigation into the circumstances surrounding the deletion of these names and related electoral-roll decisions.
