Supreme Court Directs Centre to Establish No-Fault Compensation Policy for Covid Vaccine Side Effects

In a significant ruling on Tuesday, the Supreme Court instructed the Union government to formulate a compensation policy aimed at assisting individuals who have endured adverse effects from the Covid-19 vaccine. This decision comes in light of a writ petition filed by a grieving couple, whose daughters tragically passed away due to what they assert were vaccine-related complications.

The bench, consisting of Justices Vikram Nath and Sandeep Mehta, emphasized that this new policy must operate on a ‘no-fault’ basis. This means compensation will be provided regardless of whether or not the vaccine caused the adverse effects, a concept often seen in various legal and insurance frameworks.

The petitioners, understandably distraught, have called for an independent investigation into their daughters’ unfortunate deaths. They seek rapid access to autopsy results and the findings of any probes. Alongside this, they are advocating for financial restitution and clearer guidelines for the swift identification and treatment of those experiencing side effects from vaccinations.

Interestingly, the court reiterated the importance of ongoing surveillance of adverse events following immunization. It directed that all relevant data be made publicly accessible on a regular basis, ensuring transparency and accountability in the vaccination process. However, the judges took a moment to clarify that implementing a compensation scheme should not be interpreted as an admission of liability by the government.

This latest directive underscores a growing recognition of the need for responsive measures in public health policies. As the nation continues its vaccination efforts, the clarity on compensation could provide some reassurance to those concerned about potential adverse reactions, fostering trust in the vaccination drive.
