Bombay High Court Grants Bail to Lawyer Surendra Gadling in Bhima Koregaon Case

In a significant development, the Bombay High Court has granted bail to lawyer Surendra Gadling, who has been embroiled in the controversial Bhima Koregaon case. This decision comes after Gadling spent over eight years in custody as an undertrial prisoner, a situation that the court deemed a valid basis for his release.

The bench, comprised of Justices AS Gadkari and Kamal Khata, emphasized the protracted nature of Gadling’s incarceration, noting that the trial in the case has yet to commence. Gadling’s arrest in 2018 marked a pivotal moment in a case that has drawn national attention and raised questions regarding civil liberties, state power, and the ongoing struggle for justice.

The backdrop of the Bhima Koregaon case is steeped in historical significance, as it revolves around violence that erupted on January 1, 2018, near Pune. This unrest occurred just after the Elgar Parishad conclave, which was organized to commemorate the 200th anniversary of the Battle of Bhima Koregaon—a landmark event in Indian history that symbolizes the fight against caste oppression. The violence resulted in one death and numerous injuries, further igniting tensions in a society still grappling with caste-related issues.

The National Investigation Agency (NIA) has alleged that the Elgar Parishad was part of a larger conspiracy orchestrated by Maoist groups, aimed at inciting caste violence, destabilizing the Union government, and even plotting the assassination of Prime Minister Narendra Modi. In connection with this case, 16 individuals were arrested, with Gadling being the last of them to remain in custody until now.

Despite his release, the NIA opposed Gadling’s bail petition during the hearings, citing his involvement in other criminal cases, including a 2016 arson incident where he was accused of conspiracy and destruction of property involving over 80 vehicles. This opposition reflects the NIA’s continued scrutiny and the broader implications of the case, as it raises concerns about the intersection of law, politics, and civil rights.

As the legal proceedings continue to unfold, the Bhima Koregaon case remains a flashpoint in India’s ongoing dialogue about justice, state accountability, and the rights of individuals accused of serious crimes.
