Delhi High Court Grants Bail to Kashmiri Human Rights Activist Khurram Parvez After Four-Year Detention

The Delhi High Court made a significant ruling on Wednesday, granting bail to Khurram Parvez, a prominent human rights activist from Kashmir, who had been in custody for over four years. Parvez’s release comes after a protracted legal battle, during which he was arrested by the National Investigation Agency (NIA) in November 2021 under the Unlawful Activities Prevention Act (UAPA).

Parvez, who has long been an advocate for human rights in the region, was charged with serious allegations including membership in a terrorist organization and involvement in terror financing. He faced further accusations under sections of the Indian Penal Code (IPC) related to waging war against the government and conspiring to commit terrorist acts. The NIA claimed that he supported the operations of the terrorist group Lashkar-e-Taiba through a network of operatives.

In a recent ruling, a division bench of the Delhi High Court allowed Parvez’s appeal against a December 2024 trial court decision that had denied him bail. This ruling is a pivotal moment, as it challenges the extensive use of the UAPA, which has been criticized for its stringent measures that often lead to prolonged detentions without trial.

In his bail application, Parvez argued that he had no direct involvement with the alleged conspiracy and emphasized that the investigators had failed to provide evidence linking him to the purported terrorist activities. His legal team pointed out that he was not named in the original first information report (FIR), underscoring the questionable basis of his arrest.

Khurram Parvez is notably associated with the Jammu Kashmir Coalition of Civil Society, a collective of nonprofit organizations that advocate for civil rights and social justice in the region. His activism has drawn attention to the ongoing human rights situation in Kashmir, where allegations of abuses and violations have persisted amid the longstanding conflict.
