Delhi High Court Rejects Plea to Disqualify Kejriwal and Dismantle AAP

The Delhi High Court has put an end to a public interest litigation that sought to disqualify Aam Aadmi Party (AAP) leaders, including Arvind Kejriwal, from participating in upcoming elections. The petition argued that a recent order by Justice Swarana Kanta Sharma, which initiated criminal contempt proceedings against these leaders, showcased their lack of allegiance to the Constitution. However, the court dismissed this plea on Wednesday, stating that it was ‘highly misconceived.’

A division bench comprising Chief Justice Devendra Kumar Upadhyay and Justice Tejas Karia categorically described the petition as ‘absolutely baseless and bereft of any consideration.’ They highlighted that the allegations made against the AAP leaders did not hold water. The court’s decision signals a significant victory for the party, which has been embroiled in various controversies over the years.

In addition to disqualification, the petitioner sought to have the Election Commission of India (ECI) de-register the AAP. This request was also summarily rejected by the High Court, which made it clear that the ECI does not possess the authority to rescind a political party’s registration unilaterally. The court elaborated that the Commission can only disqualify a party under three specific circumstances: if the registration was obtained through fraudulent means, if there is a change in the party’s name that does not comply with the Representation of the People Act, or if a party declares to the ECI that it no longer wishes to be registered.

The implications of this ruling extend beyond just the fate of the AAP. It underscores the judiciary’s role in safeguarding democratic processes and the legal framework surrounding political registrations. The dismissal of the plea also reflects the court’s confidence in the existing legal provisions regarding political party conduct and the responsibilities of their leaders.
