Supreme Court Petition Seeks SIT Probe Into Allegations Against CEC Gyanesh Kumar

New Delhi: A petition was filed in the Supreme Court on September 25, 2026, seeking the constitution of an independent Judicial Inquiry Commission or Special Investigation Team (SIT) to examine allegations made against Chief Election Commissioner Gyanesh Kumar.

The petition has sought an inquiry headed by a retired Supreme Court judge and has also called for an audit of Election Commission of India (ECI) databases. According to the plea, the proposed inquiry should examine issues related to the Special Intensive Revision (SIR) of electoral rolls and the deletion of voter names across several States and Union Territories.

The allegations in the petition include claims of manipulation of electoral records, changes to procedures relating to voter verification, software-related issues and other alleged irregularities in the handling of electoral rolls. These claims are contained in the petition and have not been established by a court.

The petitioner has also referred to reported differences among members of the Election Commission over certain decisions. The plea cites reports alleging that Election Commissioners Sukhbir Singh Sandhu and Vivek Joshi recorded written objections on several occasions concerning decisions attributed to the CEC.

The petition further raises legal questions concerning the protection available to the Chief Election Commissioner under the Chief Election Commissioner and other Election Commissioners Act, 2023, and argues that alleged acts outside the lawful discharge of official duties should not receive statutory protection.

The plea also refers to provisions of the Bharatiya Nyaya Sanhita and the Representation of the People Act, 1950, in support of its claims. These are legal arguments made by the petitioner and do not by themselves establish criminal liability.

The matter concerns allegations and legal submissions made before the Supreme Court. Any findings regarding the conduct of the Chief Election Commissioner or the Election Commission would depend on judicial consideration and the evidence presented in the proceedings.
