A restaurant bill has raised questions about the practice of adding a 5% “Staff Contribution (OPTIONAL)” to a customer's bill.

According to the bill shared by a customer, the restaurant added ₹53 as a “Staff Contribution (OPTIONAL) 5%” on a subtotal of ₹1,060. The final bill amounted to ₹1,189 after the additional amount, taxes and rounding.

The question is simple: Can a restaurant add such a charge to the bill merely by calling it a “staff contribution”?

The Central Consumer Protection Authority (CCPA) has already made its position clear on service charges. Restaurants cannot add a service charge automatically or by default, cannot collect it under another name, and must ensure that consumers are not forced to pay it. The CCPA guidelines state that service charge must be voluntary and optional.

The CCPA's position has also been reinforced by the Delhi High Court, which upheld the guidelines concerning mandatory service charges.

While the bill in question specifically marks the 5% contribution as “OPTIONAL,” the use of the term “staff contribution” raises an important consumer-awareness issue. Is this genuinely a voluntary contribution chosen by the customer, or is it effectively a service charge presented under a different name?

Consumers should be clearly informed of their rights and should not feel pressured to pay an additional amount they do not wish to pay.

The government and consumer authorities should consider examining such billing practices and issue clear guidance to restaurants and consumers so that there is no ambiguity.

Consumers who believe they have been wrongly charged can approach the National Consumer Helpline at 1915 or 1800-11-4000 and register a grievance.

Consumer awareness is important — an “optional” charge should genuinely remain the customer's choice.
