A collective of retired civil servants has raised serious concerns regarding remarks made by Chief Justice Surya Kant during a recent court hearing. The comments were made in the context of an appeal against the National Green Tribunal (NGT) upholding environmental clearances for the expansion of the Pipavav Port in Gujarat.

On May 11, the bench led by Chief Justice Kant declined to entertain a petition challenging the NGT’s November decision, which had dismissed an appeal aimed at reversing the clearances granted for the project. During the hearing, the Chief Justice reportedly questioned the environmental litigants present, asking, “Can you show us one project in India where environmental activists have said they welcome this project, indicating that the country is progressing well?” This sentiment was echoed by the bench, which claimed that such petitions were often filed solely to impede development initiatives.

The remarks have sparked considerable debate, with critics asserting that they reflect a troubling bias and prejudice from a pivotal figure in India’s judiciary. The Constitutional Conduct Group, which comprises former bureaucrats, expressed their dismay through an open letter, stating that the Chief Justice’s insinuations that environmental advocates obstruct development projects reveal a disturbing mindset. They emphasized that the judiciary’s role is to assess matters impartially and without preconceived notions.

The retired officials argued that the judiciary’s responsibility includes safeguarding the environment while also considering developmental imperatives. They highlighted that the Chief Justice’s statements could undermine the critical balance between development and environmental protection in India. The group reaffirmed that environmental concerns are not merely obstacles to progress but essential elements that contribute to sustainable development.

As the country strives for economic growth, the clash between developmental projects and environmental sustainability continues to be a contentious issue.
