Supreme Court Critiques Slow Progress in Lakhimpur Kheri Violence Trial Involving Ashish Mishra

The Indian Supreme Court has expressed frustration over the sluggish pace of the trial concerning the 2021 Lakhimpur Kheri violence, in which Ashish Mishra, son of former Union Minister Ajay Mishra, is one of the key accused. The comments were made by a bench comprising Chief Justice Surya Kant and Justice Joymalya Bagchi, during a hearing where they noted that no witnesses had been examined in the last two months, raising serious concerns about the proceedings.

The court’s discontent stems from the trial’s apparent lack of progress despite its significance and impact on the lives of many. The bench remarked, “What have you done since March?” signaling that they expected more decisive action from the legal authorities involved. The judges have directed the presiding judge to take necessary steps to ensure witnesses are present for the proceedings, emphasizing the need for a timely resolution to this high-profile case.

This case revolves around a tragic incident that occurred on October 3, 2021, when violence erupted during a protest against the now-repealed agricultural laws. The incident resulted in the deaths of eight individuals, including four farmers, who were allegedly struck by a vehicle driven by Ashish Mishra. Following the incident, Mishra was arrested on October 9, 2021, but currently enjoys interim bail granted by the Supreme Court.

As the trial continues, two separate cases related to the Lakhimpur Kheri incident are ongoing in a Uttar Pradesh court. The first addresses the fatalities of the protesting farmers, while the other focuses on the subsequent violence that erupted in the district. The Supreme Court’s intervention emphasizes the urgent need to expedite the judicial process, as delays can undermine public faith in the legal system, especially in cases of significant public interest.

Legal analysts suggest that the slow progression of the trial could lead to a loss of crucial evidence and witness testimonies over time, ultimately impacting the outcome of the case.
