Supreme Court Denies Congress Leader Pawan Khera’s Bail Plea in Defamation Case Linked to Assam CM’s Wife
In a significant legal development, the Supreme Court of India has turned down Congress leader Pawan Khera’s request to lift a stay imposed on a Telangana High Court order that had provided him with transit anticipatory bail. This case arose from allegations made by Riniki Bhuyan Sarma, the wife of Assam Chief Minister Himanta Biswa Sarma, who has accused Khera of defamation, forgery, and criminal conspiracy.
The Supreme Court bench, consisting of Justices J.K. Maheshwari and A.T. Chandurkar, also refused to extend Khera’s bail until April 21, which would have allowed him to seek further legal recourse in an Assam court on April 20. The justices emphasized that the observations from the High Court and the Supreme Court’s stay should not affect the Assam court’s decision regarding Khera’s plea for anticipatory bail.
Khera’s legal troubles began when he claimed on April 5 that he possessed documentary evidence indicating that Riniki Bhuyan Sarma held passports from multiple countries, including the United Arab Emirates, Egypt, and Antigua and Barbuda. In response, both the Chief Minister and his wife vehemently denied these allegations, asserting that they stemmed from fabricated documents.
The matter escalated when an FIR was lodged against Khera, prompting the Telangana High Court to initially grant him transit anticipatory bail on April 10. This type of bail is temporary, providing protection against arrest in one state while allowing an individual to approach the courts in another state.
The legal ramifications of this case are significant, as it intertwines political rivalry with complex legal questions about defamation and the rights of public figures. Khera, a vocal critic of the Assam government, has found himself at the center of a contentious political battle, with the opposition rallying around him amid claims of political witch-hunting. As the situation develops, it remains to be seen how Khera will navigate the legal landscape and what this means for his political future.
