Bombay High Court Dismisses FIRs Against Ex-DGP Sanjay Pandey in Alleged Political Conspiracy

The Bombay High Court delivered a significant verdict on Wednesday, overturning two FIRs filed against Sanjay Pandey, the former Director General of Police of Maharashtra, and lawyer Shekhar Jagtap. These cases were tied to allegations of a conspiracy aimed at framing prominent political figures, including Devendra Fadnavis of the Bharatiya Janata Party (BJP) and Eknath Shinde of Shiv Sena, during the tenure of the Maha Vikas Aghadi government.

A division bench comprising Justices Shree Chandrashekhar and Suman Shyam announced the decision, although the full order is yet to be released for public scrutiny. The controversy originated when businessman Sanjay Punamiya accused Pandey of reviving a criminal case against him, which had been previously closed in 2016. Punamiya claimed that Jagtap had produced forged documents and acted as a special public prosecutor without any official appointment.

The implications of this case stretched further, as it also implicated former Mumbai Police Commissioner Parambir Singh, who was already embroiled in numerous controversies. Allegations of extortion were leveled against both Singh and Punamiya, adding complexity to the already tangled web of accusations.

In August 2024, an FIR was lodged against Pandey, along with Assistant Commissioner of Police Sardar Patil and Inspector Manohar Patil. They were accused of coercing Punamiya into making claims against Fadnavis and Shinde, suggesting that such allegations would pave the way for legal action against the two political leaders. The high-profile nature of this case has drawn significant media attention and public interest.

The legal proceedings saw a notable turn of events as multiple judges from the Bombay High Court recused themselves from hearing Pandey’s petition to quash the FIRs. This unusual occurrence raised eyebrows and underscored the sensitivity surrounding the case, which sits at the intersection of law enforcement and political maneuvering in Maharashtra’s tumultuous political landscape.

The quashing of these FIRs by the Bombay High Court has reignited discussions about the politicization of law enforcement agencies in India.
