The Bombay High Court has taken a strong stance against the Unique Identification Authority of India (UIDAI), highlighting the undue challenges faced by citizens due to technical discrepancies in their Aadhaar records. This criticism comes in light of a recent ruling that emphasizes the importance of ensuring smooth access to services reliant on Aadhaar, which is crucial for millions of Indians.

In an order delivered on May 6, a bench comprised of Justices Ravindra V Ghuge and Hiten S Venegavkar addressed the significant implications these irregularities can have on citizens’ lives. The UIDAI, established under the Aadhaar Act of 2016, is responsible for issuing unique identification numbers to residents across the country. However, the court pointed out that the agency’s shortcomings have led to denial of services and unnecessary litigation for individuals seeking to rectify their Aadhaar details.

During the proceedings, the court specifically referenced the case of twin brothers, Rohit and Rahul Nikalje, who had faced issues updating their biometric information after obtaining their Aadhaar cards as minors in 2012. The brothers’ predicament exemplifies the broader challenges faced by many when attempting to correct technical errors in their Aadhaar records. The court remarked that eligible residents should not suffer simply due to defective biometric data, especially when there is no wrongdoing on their part.

The bench underscored the necessity of a citizen-centric approach to the implementation of Aadhaar, stressing that the integrity of the Aadhaar database must remain a priority for public interest. They directed UIDAI to take immediate measures to rectify the existing flaws in the system and ensure that citizens are not unduly burdened by these issues.
