Calcutta HC Shields TMC Candidate Jahangir Khan from Coercive Actions Ahead of Crucial Repolling

The Calcutta High Court delivered a significant ruling on Monday, providing protection to Trinamool Congress (TMC) candidate Jahangir Khan from any coercive measures by the West Bengal Police. This comes as the state prepares for repolling in the Falta Assembly constituency, set to take place on May 21, with vote counting scheduled for May 26.

Justice Saugata Bhattacharya presided over the case, where Khan expressed concerns about facing multiple criminal allegations during the election period. He argued that these accusations were aimed at politically targeting him and requested that he be made aware of any pending first information reports (FIRs) against him. The Deputy Solicitor General Dhiraj Trivedi, representing the Bharatiya Janata Party (BJP) government, contended that the charges against Khan included serious allegations of booth capturing and voter intimidation.

This development occurs in the aftermath of the recent state elections, where the BJP emerged victorious, ending a 15-year rule by the Mamata Banerjee-led TMC. The elections held on April 29 in Falta were marred by allegations of significant electoral misconduct, leading the Election Commission to mandate a repolling on May 2. Reports indicated that there were serious claims involving the manipulation of Electronic Voting Machines (EVMs), including the alleged use of black adhesive tape and perfume on ballot unit buttons to favor specific candidates.

The demand for repolling reflects the Election Commission’s commitment to ensuring a free and fair electoral process, as it investigates the complaints lodged by various political parties and candidates. Such allegations could undermine the integrity of the electoral process, making the court’s interventions critical in safeguarding democratic norms.

As the repolling date approaches, the political atmosphere in Falta is charged, with both TMC and BJP intensifying their campaigns in a bid to secure victory. Khan’s case highlights the tense political landscape in West Bengal, where the rivalry between the TMC and the BJP continues to escalate, underscoring the importance of the upcoming repolling in shaping the future political dynamics of the state.
