Calcutta High Court Grants Abhishek Banerjee Three-Week Relief from Arrest in Forgery Case

The Calcutta High Court provided temporary relief to Trinamool Congress (TMC) MP Abhishek Banerjee by granting him a three-week protection from arrest in a case involving allegedly forged signatures. The case has sparked significant political intrigue as it revolves around a letter that purportedly supported the appointment of Sovandeb Chattopadhyay as the leader of the Opposition in the West Bengal Assembly.

Justice Kausik Chanda, presiding over the matter, directed Banerjee to report to the Crime Investigation Department (CID) by 6 PM. The TMC national general secretary’s lawyer informed the court that he was currently in Delhi and would return to Kolkata by 4 PM. This request came after Banerjee had previously missed summons issued by the CID regarding the case, raising concerns about his cooperation with the investigation.

In a twist to the events, the CID conducted a search at the residence of TMC chief Mamata Banerjee, Abhishek’s aunt, while she was away in Delhi. This has added another layer of complexity to an already politically charged situation. The TMC has been under scrutiny in recent months, especially with the backdrop of tensions between rebel party members and the leadership.

The court emphasized that individuals accused of a crime should not be compelled to produce evidence that could incriminate themselves, reinforcing the safeguards outlined in Article 20 of the Indian Constitution. This article provides essential protections for accused individuals, ensuring they cannot be forced to testify against themselves.
