Delhi Court Halts FIR Against Abhijit Iyer-Mitra Over Controversial Social Media Comments

A Delhi court has intervened to stay an earlier magistrate court’s directive to file a First Information Report (FIR) against commentator Abhijit Iyer-Mitra. This decision stems from Iyer-Mitra’s controversial remarks on social media, which were deemed sexually abusive towards female employees of the news outlet Newslaundry.

The ruling was made by Additional Sessions Judge Purshotam Pathak at the Saket district court. The judge noted that Iyer-Mitra’s comments were presented in a poetic format, specifically shayari, and lacked explicit references to any individuals. The court emphasized that a comprehensive interpretation of the language employed by Iyer-Mitra could only be achieved after hearing from both parties in the matter.

Previously, the Delhi High Court had intervened after the sessions court’s order to stay the FIR was criticized for lacking adequate justification. The High Court had remanded the case back to the lower court, insisting it provide a fresh, reasoned order. This occurred after the High Court observed that the rationale for the initial stay was not clearly articulated, raising concerns about the judicial process.

In May, the High Court mandated that both Iyer-Mitra and representatives from Newslaundry, including Managing Editor Manisha Pande and other affected journalists, appear before the sessions court to address the allegations. The sessions court was directed to expedite the hearing and reach a conclusion within four weeks. This ongoing legal battle highlights the complex interplay between freedom of expression and the responsibilities that come with it, especially in the age of social media.

The case has garnered significant attention, as it touches upon broader issues of accountability and the treatment of women in the media industry. As the court proceedings unfold, many are watching closely to see how the judiciary navigates these sensitive topics, which are increasingly prominent in Indian discourse.
