Delhi High Court Dismisses ED Case Against NewsClick, Citing Abuse of Legal Process

The Delhi High Court has made a significant ruling by dismissing an FIR and a case filed by the Enforcement Directorate (ED) against the news portal NewsClick and its editor-in-chief, Prabir Purkayastha. This decision, delivered by Justice Neena Bansal Krishna on May 29, characterized the legal actions as a blatant misuse of power and a threat to the tenets of free and independent journalism in India.

The case against NewsClick stemmed from allegations of illicit foreign funding, specifically accusing the organization of receiving ₹9.5 crore in foreign direct investment from the US-based Worldwide Media Holdings LLC. Authorities claimed that this transaction was conducted through an inflated share valuation to bypass foreign investment regulations. The Economic Offences Wing (EOW) contended that a substantial portion of these funds was misappropriated through salaries and consultancy fees, raising serious concerns about the integrity of the financial dealings.

In her judgment, Justice Krishna highlighted the lack of merit in the proceedings, stating that they represented an enterprise driven by malice rather than factual evidence. She underscored that allowing this case to proceed would amount to a profound violation of legal protocols, which should serve to protect, rather than undermine, journalistic freedom. The judge noted that NewsClick had, prior to the allegations, sought clarity from the Ministry of Information and Broadcasting regarding foreign direct investments in digital news media, demonstrating their commitment to operate within the legal framework.

This ruling is significant in the context of a broader narrative surrounding the treatment of independent media in India. In recent years, several media outlets have faced scrutiny and legal challenges, leading to concerns about press freedom and the safety of journalists.
