The Delhi High Court has taken a significant step by issuing notices to journalist Saurav Das and Aam Aadmi Party (AAP) leader Gopal Rai in a criminal contempt case. This decision stems from allegations asserting that the duo participated in a coordinated campaign targeting Justice Swarana Kanta Sharma. The court’s move reflects its commitment to upholding judicial integrity amid rising tensions between the judiciary and political figures.
On a recent Friday, a division bench comprising Justices Navin Chawla and Ravinder Dudeja addressed the contempt petition that accused Das and Rai of running a campaign on social media that aimed to malign the reputation of Justice Sharma. It was noted that while notices were sent to Das and Rai, AAP chief Arvind Kejriwal and party leader Saurabh Bharadwaj were not included in this round of notices. This exclusion was due to the fact that proceedings against Kejriwal and Bharadwaj are already underway based on the court’s own initiative.
The controversy erupted after a petition was filed by a lawyer who claimed that Das, Rai, and their AAP colleagues engaged in a systematic effort to discredit Justice Sharma through a series of posts on the platform X (formerly Twitter). The allegations made against the judge included accusations of conflict of interest and bias, which were reportedly based on misleading information about the professional roles of Justice Sharma’s family members.
The legal action was spurred by the lawyer’s receipt of consent from Sanjeev Bhandari, the Additional Standing Counsel for the Delhi Bharatiya Janata Party (BJP) government. This highlights the growing intersection of politics and the judicial system in India, where social media has become a battleground for public opinion and political rivalry.
The case is poised to be heard in tandem with the ongoing contempt proceedings involving Kejriwal and Bharadwaj, underscoring the urgent need for clarity and accountability among public figures who utilize their platforms to communicate with the masses. The court’s actions serve as a reminder that freedom of speech, especially in the political realm, must be exercised with responsibility and respect for the judicial process.
