Delhi High Court Orders Restoration of 4PM News YouTube Channel Blocked by Government

The Delhi High Court has made a significant ruling concerning the controversial YouTube channel 4PM News, which was blocked earlier this year by the Indian government due to purported national security concerns. The court’s decision, delivered on May 5, mandates the restoration of the channel, while also upholding the ban on 26 specific videos deemed objectionable.

The saga began on March 12 when the Union government issued directives under the Information Technology Rules to block the channel, citing threats to national security and public order. This decision was met with backlash from 4PM News and its editor, Sanjay Sharma, who filed a petition challenging the government’s actions. The petition highlighted the lack of formal communication from both Google, the parent company of YouTube, and the Ministry of Electronics and Information Technology regarding the reasons behind the ban. This absence of clarity hindered their ability to defend themselves effectively, they argued.

Justice Purushaindra Kumar Kaurav presided over the case and criticized the government’s approach, emphasizing the need for transparency and the importance of due process. During the proceedings, Additional Solicitor General Chetan Sharma represented the government, asserting that an Inter-Departmental Committee had reviewed the content on 4PM News and determined that it posed risks to India’s sovereignty and public safety.

The government contended that the channel was disseminating conspiracy theories and information that could potentially incite unrest. However, the court’s ruling to overturn the ban on the channel reflects a growing discourse on the balance between national security and the freedom of expression in India.
