Madhya Pradesh High Court Declares Bhojshala-Kamal Maula Complex as Hindu Temple

The ongoing dispute surrounding the Bhojshala-Kamal Maula mosque complex in Dhar district, Madhya Pradesh, has taken a significant turn following a ruling from the Madhya Pradesh High Court. In a decision delivered on Friday, a bench comprising Justices Vijay Kumar Shukla and Alok Awasthi asserted that the site is fundamentally a temple dedicated to the Hindu goddess Saraswati, renouncing its previously held status as a mosque.

The court’s ruling came in response to a challenge against a 2003 directive from the Archaeological Survey of India (ASI), which sanctioned limited access for both Hindus and Muslims to conduct their respective religious practices at the complex. Under that order, Hindus were permitted to worship on Tuesdays, while Muslims could offer prayers on Fridays. However, the High Court has now set aside this arrangement, declaring the site a temple.

In a notable part of the verdict, the court has allowed the Muslim community to request alternative land within the Dhar district for the construction of a mosque. The judges advised that any such application made to the state government should be considered “in accordance with law,” reflecting a willingness to find a solution that respects the rights of both communities.

Historical and archaeological evidence played a pivotal role in the court’s decision. The bench noted that various documents highlighted the site’s historical significance as a hub for Sanskrit learning, previously housing a temple dedicated to the goddess of knowledge, Saraswati. This assertion has further fueled the ongoing debate about the site’s identity and its historical context, as it touches upon the sensitive intersection of faith, heritage, and community identity.

Additionally, the court has directed the Union government and the ASI to formulate a strategy for the management and administration of the complex. The ASI has been tasked with retaining full supervisory control over the preservation and regulation of religious practices at the site. The court’s directive signals the importance of maintaining the site’s historical integrity while accommodating the diverse religious sentiments associated with it.

This ruling is likely to spark widespread reactions across the religious and political spectrum in India. The Bhojshala-Kamal Maula complex has been a focal point of contention between Hindu and Muslim communities for years, with each group claiming historical ownership and significance. As the state prepares for potential repercussions and further discussions, the ruling adds a new chapter to the complex narrative of historical and religious disputes in India.
