Madras High Court Agrees to Hear Petition Against TVK Leader Vijay for Alleged Income Tax Evasion

The Madras High Court has announced that it will examine a petition calling for an investigation into Tamilaga Vettri Kazhagam (TVK) leader Vijay regarding allegations of income suppression and the acceptance of unaccounted cash. This decision comes after the court instructed its registry to include the case on its list, despite prior hesitance regarding the petition’s maintainability.

The legal action was initiated by M. Rajkumar, who filed the petition earlier this year in April, urging the Income Tax Department to scrutinize evidence from various search operations, Vijay’s sworn statements, assessment proceedings, and penalty orders. The petition seeks to activate legal proceedings under the Income Tax Act, including clauses that address the prosecution of individuals who deliberately evade tax obligations.

Initially, the registry had expressed doubts about the petition’s validity, leading to its reluctance to list the case. However, a bench led by Chief Justice S.A. Dharmadhikari and Justice G. Arul Murugan clarified that it is the court’s responsibility to determine the maintainability of the petition, not the registry’s. The court emphasized that if there are questions regarding the petition’s legitimacy, it should still be numbered with a note indicating that it is “subject to maintainability” before being presented to a judge.

This ruling underscores the judiciary’s commitment to ensuring that all petitions are given due consideration, regardless of preliminary objections raised by administrative bodies. The court’s stance advocates for the principle that the merit of a case should be evaluated by judges rather than by registry officials.

The implications of this case could be significant, not only for Vijay but also for the broader political landscape in Tamil Nadu, where political leaders often face scrutiny concerning their financial dealings.
