Madras High Court Orders CBI Investigation into Transformer Tender Scam Linked to DMK’s V Senthil Balaji

The Madras High Court has instructed the Central Bureau of Investigation (CBI) to investigate an alleged scam involving the procurement of transformers, purportedly resulting in a staggering loss of ₹397 crores to the Tamil Nadu state exchequer during the tenure of V Senthil Balaji as the state’s electricity minister. This directive was issued on Wednesday as part of ongoing legal proceedings concerning irregularities in the tendering process.

The controversy centers around the procurement practices followed by the Tamil Nadu Generation and Distribution Corporation (TANGEDCO), which is responsible for acquiring distribution transformers that cater to varying load-capacity requirements. The alleged financial misconduct is said to have occurred between 2021 and 2023, during which Balaji, a prominent leader of the Dravida Munnetra Kazhagam (DMK) party, held the ministerial position.

The court’s ruling came in response to a writ petition filed by Arappor Iyakkam, a non-governmental organization focused on promoting transparency and accountability. The organization, along with members of other political parties, lodged a complaint with the Directorate of Vigilance and Anti-Corruption (DVAC) on July 6, 2023. When the DVAC appeared unresponsive, Arappor Iyakkam sought the Madras High Court’s intervention to expedite the investigation process.

During the court proceedings, the First Division Bench led by Chief Justice Sushrut Arvind Dharmadhikari and Justice G Arul Murugan mandated that all investigation materials related to the case be transferred to the CBI within two weeks. The bench emphasized the need for a thorough examination of the allegations, indicating that the central agency must conduct a fresh inquiry into the matter.

Reports suggest that the alleged irregularities revolved around ten tenders issued from 2021 to 2023 for the procurement of approximately 458,000 distribution transformers, amounting to a total estimated cost of ₹1,182 crores. The NGO has claimed that certain tenders were manipulated to favor particular contractors, raising concerns about the integrity of the bidding process.

The implications of this ruling are significant, as it not only reflects the judiciary’s commitment to combating corruption but also highlights the accountability of public officials in managing state resources. As the CBI gears up for an investigation, this case could serve as a critical litmus test for transparency in government operations, particularly in sectors involving substantial public expenditure.

Furthermore, this situation underscores the ongoing challenges faced by the Tamil Nadu government in ensuring ethical governance, especially in a politically charged environment where allegations of corruption frequently surface.
