Supreme Court Grants Anticipatory Bail to Pawan Khera Amid Political Controversies

In a significant legal development, the Supreme Court of India has granted anticipatory bail to Congress leader Pawan Khera, who faced legal troubles stemming from accusations made by Riniki Bhuyan Sarma, the wife of Assam Chief Minister Himanta Biswa Sarma. This ruling came after Khera challenged an earlier decision by the Gauhati High Court, which had denied him similar relief.

The Supreme Court bench criticized the High Court’s decision, describing its observations as “erroneous” and stating that it had improperly shifted the burden of proof onto Khera. The apex court pointed out that the allegations against Khera, which include defamation, forgery, and criminal conspiracy, appeared to be politically motivated and did not justify custodial interrogation, thus highlighting the potentially problematic nature of the case.

Pawan Khera’s legal troubles began when he alleged that Sarma was in possession of multiple passports, a claim that subsequently led to the charges against him. Khera’s situation has ignited discussions about the intersection of politics and law in India, especially in the context of allegations that often arise during politically charged times.

In a related political context, the Calcutta High Court has also made headlines by dismissing a petition from the Trinamool Congress, which challenged the Election Commission’s directive to use central government employees as counting supervisors for the upcoming West Bengal Assembly election results. This decision is significant, especially since the counting is set to take place on a Monday, further intensifying the political atmosphere in the state.

The Election Commission had mandated that at least one central government employee be present at each counting station, a move that Trinamool Congress officials argued could influence the integrity of the counting process. As the state gears up for this critical event, the decision reflects ongoing tensions between the ruling party in West Bengal and the central government, suggesting that the political landscape remains fraught with challenges.
