In a significant development regarding the Delhi liquor policy case, Justice Swarana Kanta Sharma of the Delhi High Court has dismissed a plea from Aam Aadmi Party (AAP) leader Arvind Kejriwal and others, urging her to recuse herself from the proceedings. The judge’s decision came on Monday, as reported by Live Law, and marks a crucial moment in an ongoing legal battle surrounding the controversial liquor policy.

Justice Sharma had previously reserved her judgment in this matter on April 13, indicating that she would not allow the recusal application to influence her ruling on the substantive issues at hand. In her remarks, she emphasized that stepping down from the case would not be an act of prudence but rather a dereliction of judicial duty. “Recusal would not be prudence but abdication of duty,” she stated, reinforcing the integrity of the judiciary by asserting that it should confront allegations without capitulating to claims against its members.

During the proceedings, Kejriwal had filed an affidavit on April 14, arguing that the judge’s impartiality could be compromised due to her familial connections. He pointed out that her son and daughter have been appointed as counsels for the Central Government, which he contended could create a conflict of interest. This argument was further complicated as Solicitor General Tushar Mehta represents the Central Bureau of Investigation (CBI) in the case, raising concerns about the fairness of the judicial process.

Justice Sharma’s response to the recusal request was firm; she articulated that the application itself might undermine the very foundation of the judiciary by subjecting it to unwarranted scrutiny. “The strength of the judiciary lies in its strong resolve to decide the accusations,” she remarked, highlighting her commitment to maintaining judicial independence. She indicated that the main case against Kejriwal and others, which is being presented by the CBI, will proceed as scheduled for a further hearing on April 29, noting that some of the respondents had yet to submit their replies.

This ongoing legal confrontation highlights the political tensions surrounding the Delhi liquor policy, which has been a contentious issue since its inception. Kejriwal, who previously served as the Chief Minister of Delhi, is at the center of this controversy, with his party facing allegations of corruption linked to the execution of the policy. As the case unfolds, it continues to attract significant attention from the media and the public, as it encapsulates the intersection of politics and justice in India.
