Delhi High Court Overturns Centre's Rejection of Siddharth Varadarajan's OCI Card Application

The Delhi High Court has made a significant ruling by overturning the Union government’s decision to reject the Overseas Citizen of India (OCI) card application submitted by Siddharth Varadarajan, the founding editor of The Wire. This ruling, delivered on Tuesday, highlights the importance of transparency and accountability in governmental processes regarding immigration status.

Varadarajan, who holds United States citizenship, previously possessed a Person of Indian Origin (PIO) card. However, due to a recent policy shift by the Indian government which merged the PIO and OCI schemes, all PIO cards expired on December 31, 2022. As a result, Varadarajan sought to upgrade his status to an OCI card, which allows foreign nationals of Indian descent to live and work in India indefinitely.

After submitting his application, Varadarajan faced an unexpected setback when his request was denied without any explanation from the Union government. This prompted him to approach the Delhi High Court for a rightful review of the decision. In a notable observation, Justice Purushaindra Kumar Kaurav remarked that the rejection notice dated April 2 lacked necessary reasoning, which is vital in any judicial or administrative decision-making process. The judge emphasized that a decision without rationale lacks legitimacy and cannot be upheld.

The counsel representing the Union government acknowledged the court’s concerns and indicated a need to seek further instructions from relevant authorities regarding the matter. However, Justice Kaurav was firm in his stance that the absence of a clear explanation rendered the government’s rejection unsustainable.

This ruling not only sheds light on an individual case but also raises broader questions about the processes governing OCI applications and the treatment of individuals of Indian origin. As more people seek to reconnect with their roots and establish ties to India, the necessity for a clear and fair immigration system becomes increasingly evident.
