The complaint, lodged by an individual named Rajib Sarkar, was filed on May 5 at the Baguiati Police Station, just a day after the election results were made public. According to Sarkar, Banerjee’s speeches during the election campaign, which took place between April 27 and May 3, were inflammatory and aimed at inciting public unrest. Sarkar’s report specifically highlighted that Banerjee’s rhetoric not only encouraged hostility but also disrupted public harmony.

In his statements, Abhishek Banerjee allegedly challenged Amit Shah to appear before the public without the security provided by central forces, indicating that the TMC was ready to confront the Bharatiya Janata Party (BJP) in what he termed a political battle. This provocation has drawn significant attention, as it raises questions about the boundaries of political discourse in a highly charged electoral environment.

The case against Banerjee has been filed at the Bidhannagar Cyber Crime Police Station, invoking various sections of the Bharatiya Nyaya Sanhita.
