Jammu and Kashmir High Court Overturns AAP MLA Mehraj Malik's Detention Under Public Safety Act

The Jammu and Kashmir High Court delivered a significant ruling on Monday by quashing the preventive detention of Mehraj Malik, an MLA from the Aam Aadmi Party (AAP). This decision came as a relief for Malik, who had been held under the controversial Public Safety Act (PSA) for nearly a year following an order from the Doda district administration issued in September.

Malik, representing the Doda constituency, was the first sitting legislator in the Union Territory to find himself detained under this stringent law, which is designed to prevent individuals from engaging in activities deemed a threat to public order or state security. The PSA has faced criticism for its broad interpretation and potential for misuse, often leading to arbitrary detentions.

In a detailed judgment, Justice Mohammad Yousuf Wani of the High Court highlighted that the reasons provided for Malik’s detention failed to satisfy the legal requirements associated with establishing a threat to public order. The court emphasized that many of the allegations against Malik were already being addressed through existing first information reports (FIRs), indicating that the judicial system could function without the need for preventive detention.

Justice Wani articulated that utilizing preventive detention should not replace regular legal processes, asserting that doing so undermines the investigative authorities’ responsibilities. The ruling underscores the necessity of adhering to established legal principles and the importance of safeguarding individual freedoms, especially when it comes to elected officials.

This landmark ruling is expected to resonate throughout Jammu and Kashmir, a region often marred by political tensions and a complex security environment. Malik’s detention had raised eyebrows and ignited discussions about civil liberties and the use of the PSA, which, critics argue, is often wielded to stifle political dissent and silence opposition voices.

As the political landscape in Jammu and Kashmir continues to evolve, with parties like the AAP gaining traction, the High Court’s decision may serve as a pivotal moment in reinforcing democratic values and the rule of law in the region. Observers will now watch closely to see if this ruling impacts future applications of the Public Safety Act and how it is implemented by local authorities.
