SUPREME COURT OF INDIA ROPED IN POLITICAL PROTESTS

The Opposition Parties or the INDIA BLOC, comprising the Indian National Congress and other parties along with CJP i.e., Cockroach Janta Party and a slew of social and political activists joined in a march to the Supreme Court of India beseeching the Chief Justice of India to step in and take action against the Election Commission of India including sacking of the Chief Election Commissioner, Gyanesh Kumar.

This move came after days of massive protests at Jantar Mantar and persistent efforts by the Union Administration to quell or dispel the protests including taking extreme measures such as refusing permission to hold peaceful protests at Jantar Mantar, the traditional and historic venue for protests in the heart of the capital, closure of roads, metro stations, picking up of likely demonstrators or protestors from their homes, airports and railway stations.

However, such a move i.e., seeking to meet the Chief Justice of India on the non-judicial side, that being administrative side, calling upon for steps or action as stated above be made or is such a move, correct or lawful is the right question to be discussed and analysed in the public domain.

There is no legal backing or precedent or any express provision of any law which permits such a move. And moreover, such a move clearly touches upon and infringes the basic principle and constitutional principle of separation powers. The Supreme Court of India and all Courts in this country can be approached by any one including say a political party and present its case backed with evidence or documentary material. This is the basic procedure which is to be followed and must be followed. Any deviation from such a long-standing and well-established process can have dangerous ramifications. If the CJI or Supreme Court Judges are to meet politicians or political outfits on the non-judicial side to discuss any issue then the same can have a cascading effect on our laid down constitutional principles including the important principle of separation of powers. The incumbent CJI, Justice Surya Kant very correctly observed that any one can file a petition which can be heard and decided on merits in accordance with law.

Public memory is extremely short and many have forgotten the not so long news where a Parliamentary Committee sought to meet the CJI and Supreme Court Judges to discuss a new law being brought that being on the One Nation One Election. There is not much clarity as to how a time and date were fixed for such panel to come to the Supreme Court to meet the CJI and other Supreme Court Judges, however, press conference including by Kapil Sibal, Senior Advocate, Ex-Union Minister and incumbent independent Rajya Sabha M.P., and wide reporting on this issue seemingly did not let this event go through which again would have seriously and grossly infringed the core constitutional principle of separation of powers.
