Supreme Court Orders UP Police to Present Protest Accused Amid Custodial Torture Allegations

In a significant development, the Supreme Court of India has mandated the Uttar Pradesh Police to present two individuals, arrested in connection with a recent workers’ protest in Noida, in court. This order comes following alarming allegations of custodial torture made by a family member of one of the accused, Aditya Anand. The bench, comprising Justices BV Nagarathna and Ujjal Bhuyan, has scheduled the court appearance for 2 PM on Monday.

The case revolves around the protest that took place in April, during which Anand and another man, Rupesh Roy, were apprehended for allegedly inciting violence. Anand’s brother has raised serious concerns about his brother’s treatment while in custody, claiming that he was subjected to torture. The legal representation for Anand’s family, led by advocate Colin Gonsalves, provided the court with a glimpse into Anand’s character, stressing that he is an engineer employed at a local factory and also operates a children’s library, showcasing his commitment to social causes.

Gonsalves argued that Anand’s speeches during the protests were centered on advocating for workers’ rights, and emphasized that recordings of these speeches exist to support this assertion. He expressed a strong desire for an independent investigation into the claims of custodial abuse, stating, “Now things have got a little bit out of hand,” highlighting the urgency and seriousness of the situation. Additionally, Gonsalves alleged that the legal representatives for Anand faced physical obstruction while trying to assist him, further complicating the case.

Conversely, the representatives for the Uttar Pradesh government dismissed the allegations of torture, asserting that all procedures were followed according to the law. This stark contrast in narratives has raised questions about the treatment of individuals in custody and the accountability of law enforcement agencies.

The upcoming court appearance will serve as a crucial moment in the ongoing saga surrounding the rights of workers and the treatment of those who stand up for them.
