Delhi High Court Grants Umar Khalid Three-Day Bail for Mother's Surgery Amidst Controversy

The Delhi High Court has granted activist Umar Khalid a three-day interim bail from June 1 to June 3, allowing him to attend to his mother’s medical needs. This decision comes amidst ongoing concerns related to the 2020 Delhi riots conspiracy case, in which Khalid has been embroiled since his arrest.

Umar Khalid, a former student of Jawaharlal Nehru University, had sought a 15-day bail to participate in the Chehlum ritual, commemorating the 40th day since his uncle’s demise, and to care for his mother, who is scheduled for surgery on June 2. Initially, a lower court had rejected his plea, prompting Khalid to escalate the matter to the High Court.

During the proceedings, Khalid’s lawyer, Trideep Pais, highlighted that the activist had previously been granted interim bail in December for his sister’s wedding and had received similar permissions in the past for short durations in both 2022 and 2024. This history suggests a pattern of the court recognizing Khalid’s family obligations, despite the serious charges against him.

On the other hand, Additional Solicitor General SV Raju, representing the Delhi Police, argued against the bail. He claimed that Khalid’s mother was only undergoing a minor surgical procedure and that there were sufficient family members, including Khalid’s sisters, to provide care. Raju suggested that Khalid could visit his mother for the surgery and return the same day with police supervision.

In a surprising turn, the High Court ultimately decided to grant Khalid the temporary relief, signaling an empathetic understanding of his familial circumstances. This decision has drawn mixed reactions, with some viewing it as a necessary allowance for personal matters while others remain wary of the implications given Khalid’s ongoing legal challenges.
