Delhi High Court Orders Immediate Removal of False Reports Alleging Misconduct by Chief Justice

The Delhi High Court has taken a decisive step to uphold judicial integrity, ordering the removal of completely unfounded reports that claimed Chief Justice of India Surya Kant, along with several other judges and Union ministers, had traveled to London at public expense to participate in a badminton tournament. The judgment, delivered by Justice Tejas Karia on Friday, comes in response to a petition filed by the Badminton Association of India.

In its ruling, the court directed that multiple media reports and social media postings making these allegations be taken down, deeming them “false, malicious, and derogatory.” Justice Karia mandated that the government issue notifications to social media platforms and search engines, requiring them to eliminate the impugned content within 24 hours. This move aims to prevent the spread of misinformation that could potentially harm the reputations of the judiciary and public officials.

The court’s order explicitly restrains the public from uploading, disseminating, or sharing this misleading content across any online platforms. It specifically mentioned reports published by prominent news outlets, including The Print, National Herald, and The Tribune, alongside a post from Shiv Sena (Uddhav Balasaheb Thackeray) leader Priyanka Chaturvedi.

The Badminton Association of India argued that such defamatory assertions undermine the independence of the judiciary, suggesting that judges and ministers would engage in activities that blur the lines of professionalism and accountability. Solicitor General Tushar Mehta, representing the government, pointed out that the images accompanying these posts were misattributed and not linked to the alleged events in question.

This incident highlights the growing concerns over misinformation in the digital age, where social media can rapidly amplify unfounded claims. The court’s intervention is seen as a crucial measure to safeguard the dignity of the judiciary and ensure that such baseless allegations do not disrupt public trust in legal institutions. Judicial independence is a cornerstone of democracy, and protecting it from the scourge of misinformation is essential for maintaining the rule of law in India.
